About these terms
By using the website, accepting a quotation, paying an advance or confirming a booking, you agree to these terms and any booking-specific conditions stated in the confirmed quotation. If a confirmed quotation expressly differs from these general terms, the quotation will apply to that booking to the extent of the difference.
Chauffeur-driven services only
CROSCAR provides chauffeur-driven vehicles only. We do not provide self-drive rentals, and customers or passengers are not permitted to drive, move or operate the booked vehicle under any circumstances.
Enquiries, quotations and booking confirmation
- Website content, displayed vehicles, messages and verbal discussions are invitations to enquire and do not constitute a confirmed booking.
- A quotation is based on the information available when it is issued and remains valid only for the period stated in that quotation.
- A booking is confirmed only after CROSCAR issues written confirmation and receives the required advance or other agreed payment.
- Vehicle availability, route feasibility, pickup access, city operations and chauffeur duty limits are checked before confirmation and may change until the booking is confirmed.
- You are responsible for checking the confirmed date, time, route, vehicle category, package, price and contact details and reporting any error promptly.
Pricing, packages, taxes and payment
Unless the confirmed quotation states otherwise, full payment of 100% of the total quoted amount is required in advance to confirm the booking. A booking will be considered confirmed only after CROSCAR has received the full payment.
Rates may be based on a defined time-and-distance package, route, event duration, airport transfer, local rental, outstation itinerary or other agreed scope. Usage beyond the included time, distance or scope will be charged at the rates stated in the quotation or booking confirmation.
- Tolls, parking, airport charges, permits, state or entry taxes, interstate charges, waiting charges, night allowances, chauffeur outstation allowances and other trip-specific expenses are payable by the customer unless expressly included in the quotation.
- Applicable GST or other taxes will be charged as stated in the quotation or invoice and as required by law.
- A failed, reversed or disputed payment does not confirm a booking. CROSCAR reserves the right to release the vehicle and make it available for other bookings until the payment is successfully received.
- Payments must be made only through the account, link, QR code or method officially communicated by CROSCAR.
Vehicle availability and substitution
Vehicle model, colour, registration year and variant are subject to city, fleet availability and final booking confirmation. Similar-category vehicles may be offered when the requested model is unavailable.
CROSCAR may provide a vehicle from the same or a higher category when the confirmed vehicle becomes unavailable because of breakdown, delayed return, safety concerns or another operational issue. If only a lower category is accepted by the customer, the applicable price difference will be adjusted or refunded.
Customer information and booking requirements
- You must provide complete and accurate pickup, drop, date, time, passenger, route, luggage, flight or train and billing information required for the service.
- You must inform CROSCAR in advance about child seats, accessibility requirements, oversized luggage, pets, event access, restricted roads, security protocols or any other requirement that may affect vehicle selection or operations.
- The passenger count and luggage must remain within the safe and lawful capacity of the confirmed vehicle.
- The pickup and destination locations must provide lawful and reasonably safe vehicle access. Additional walking, alternate pickup or a different vehicle may be required for narrow, restricted or unsafe locations.
- The booking customer must provide one valid government-issued photo ID (such as Aadhaar Card, Passport, Driving License, or Voter ID). Failure to do so may result in cancellation of the booking.
Pickup, waiting time, route and delays
Pickup and journey times are estimates and may be affected by traffic, weather, road closures, security checks, airport operations, local restrictions and other conditions beyond reasonable control. Customers should allow appropriate buffer time for flights, trains, meetings and events.
Where flight or train details are provided, CROSCAR may use available tracking information for coordination, but tracking accuracy is not guaranteed. Waiting beyond the included period may be chargeable under the confirmed quotation.
Passenger conduct and prohibited use
- Passengers must follow lawful safety instructions from the chauffeur and use seat belts where available.
- Smoking, consumption of alcohol, illegal substances, unlawful activity, dangerous conduct and carrying prohibited goods are not permitted in the vehicle.
- Abusive, threatening, discriminatory or unsafe behaviour toward the chauffeur, staff, partners or other passengers is prohibited.
- CROSCAR or the chauffeur may refuse or terminate service where continuing the journey would be unlawful, unsafe or abusive. Charges for the affected service may remain payable where termination results from customer or passenger conduct.
Damage, excessive cleaning and misuse
The customer is responsible for loss, damage, vandalism or excessive cleaning caused by the customer, passengers, invitees, pets or luggage, excluding ordinary wear and tear. CROSCAR may recover the reasonable repair, replacement, cleaning, downtime and administrative costs supported by available evidence.
Any incident or damage must be reported immediately to the chauffeur or CROSCAR support. Customers must cooperate with lawful insurance, police or incident-reporting requirements.
Personal belongings
Passengers are responsible for their baggage, valuables and personal belongings. CROSCAR will make reasonable efforts to help locate an item reported as lost, but cannot guarantee recovery or accept responsibility for items left in a vehicle, except where liability cannot lawfully be excluded.
Booking changes, cancellation and no-show
Requests to change a date, time, route, vehicle, package or passenger requirement are subject to availability and price revision. A material change may be treated as a cancellation and new booking.
Cancellations, no-shows and refunds are governed by the Cancellation Policy and any special cancellation condition accepted in the confirmed quotation.
Operational disruption and force majeure
CROSCAR is not responsible for delay or failure caused by events beyond reasonable control, including severe weather, natural disasters, road closures, government restrictions, civil disturbance, strikes, public emergencies, communication failures or similar events. We will make reasonable efforts to inform you, arrange an alternative or reschedule the affected service where practical.
Liability
Nothing in these terms excludes liability that cannot be excluded under applicable law. Subject to that restriction, CROSCAR is not liable for indirect, incidental, special or consequential loss, including missed flights, trains, meetings, events, business opportunities or third-party bookings resulting from traffic, delay, cancellation or service disruption.
To the maximum extent permitted by law, CROSCAR's aggregate liability for a claim relating to a booking will not exceed the amount paid to CROSCAR for the affected service. This limitation does not apply to fraud, wilful misconduct or any liability that applicable law does not permit us to limit.
Corporate and third-party bookings
Where a company, travel arranger or another person makes a booking for a passenger, the person confirming the booking represents that they are authorised to do so and to accept these terms. The booking party remains responsible for payment unless CROSCAR agrees otherwise in writing.
Website content and intellectual property
The CROSCAR name, website design, text, graphics and original content are owned by or licensed to CROSCAR and may not be copied, modified, distributed or commercially used without prior written permission.
Vehicle manufacturer names, marks and images belong to their respective owners. Their appearance on the website identifies vehicle categories or models and does not imply sponsorship, endorsement or ownership by CROSCAR.
Governing law and jurisdiction
These terms are governed by the laws of India. Subject to any mandatory consumer forum or statutory remedy available under applicable law, disputes arising from these terms or CROSCAR services will be subject to the exclusive jurisdiction of the competent courts at New Delhi, India.
Changes, severability and waiver
We may update these terms for future website use and bookings. The version accepted with a confirmed booking will continue to govern that booking unless the parties agree otherwise in writing.
If any provision is held invalid or unenforceable, the remaining provisions will continue in effect. A delay or failure to enforce a provision does not waive the right to enforce it later.
